WASHINGTON (AP) – Former President Donald Trump is suing a House of Representatives committee investigating the January 6 att*ck on the US Capitol in an attempt to block a call to testify.

“Long-held precedent and practice hold that separation of powers prohibits Congress from forcing the president to testify to him,” said Trump attorney David A. Warrington in a statement announcing Trump’s intentions.

He said Trump “has committed to the Committee’s efforts in good faith to address these issues in accordance with the prerogatives of the executive and separation of powers,” but said the panel “insists on following the political path, leaving President Trump to have no choice but to engage the third branch, the judiciary, including the dispute between the executive and the legislature ”.

The commission voted to summon Trump during the last mid-term pre-election hearing and formally did so last month, demanding testimony from the former president. Committee members say Trump “personally arranged” a multi-part effort to overturn the 2020 election results.

They said Trump must testify either at the Capitol or by videoconference, “starting or about” November 14 and continuing for days if necessary.

The letter also contained an extensive request for documents, including personal communications between Trump and members of Congress and extremist groups.

The lawsuit comes as Trump is set to launch his third presidential campaign next week.
